CNR presentation :
Le Comité National Routier (ci-après le « CNR ») est un comité professionnel de développement économique dont les missions sont principalement l’observation et le suivi des aspects économiques du marché du transport routier de marchandises et du marché du transport routier collectif de personnes (hors transports urbains et suburbains de personnes), notamment à travers l’analyse des coûts, la réalisation et la diffusion de travaux de recherche et d’études portant sur lesdits marchés.
Le CNR met à disposition des Utilisateurs le présent Site Internet, accessible à l’adresse https://www.cnr.fr, dont les conditions d’accès et d’utilisation sont régies par les présentes Conditions Générales d’Utilisation.
Definitions :
“Terms of Service or TOS”. means the provisions herein governing access to and use of the Site and its Services.
“Data ” refers to all the information communicated by the User during his/her visit, as well as any element collected automatically by the Site during his/her visit, and used to improve the Site.
« Site » refers to the CNR website located at the URL «www.cnr.fr», including all pages of said website.
« Services » désigne les services proposés par le CNR sur son Site et définis à l’article 2.
Les Services regroupent des services gratuits ainsi que des services payants, étant précisé que ces derniers font l’objet de conditions générales de vente (ci-après « CGV ») accessibles depuis le lien suivant : GTCS
« User » désigne toute personne morale ou physique visitant le Site « www.cnr.fr », ainsi que l’ensemble des pages dudit Site.
Article 1 - Purpose
1.1. Les présentes Conditions Générales d’Utilisation ont pour objet de définir les modalités et conditions d’utilisation du Site et des Services disponibles sur le Site que le CNR met à disposition des Utilisateurs, ainsi que les relations entre le CNR et les Utilisateurs.
Browsing on the Site automatically entails the User's full and unreserved acceptance of these GTCU.
The applicable GTCU are those in force at the time of each navigation of the User to the Site. Consequently, the User is invited to read the Terms and Conditions of Use each time he visits the Site.
These GTCUs can be modified at any time by the CNR as necessary. In this case, the User acknowledges that his use of the Site after modification of the GTCUs will automatically imply acceptance of the GTCUs thus modified.
1.2. If a User uses the Site on behalf of an entity (e.g., association, company, foundation), he guarantees that he holds all the necessary authorizations to accept the GTCU on behalf of the entity for which he uses the Site. In this case, his access to the Site will also entail unreserved acceptance of the GTCU by the entity in question.
Article 2 - Description of the site
The Site provides access to various Services made available by CNR.
In particular, it provides access to the following Services:
- La mise à disposition d’indices et de statistiques ;
- Des publications sur des sujets divers ;
- La newsletter du CNR ;
- Des outils permettant d’effectuer des simulations (notamment des outils permettant de calculer l’indexation de prix ou encore le simulateur de coût de revient d’un véhicule de transport routier) ;
Le Site propose également des Services payants dont les caractéristiques et conditions particulières sont détaillées au sein des CGV accessibles depuis le lien suivant : GTCS .
Le CNR se réserve la possibilité de proposer gratuitement tout ou partie des Services payants détaillés au sein des CGV à certains Utilisateurs qui auront bénéficié d’un code à cet effet.
Dans cette hypothèse, l’Utilisateur devra créer un compte Utilisateur sur le Site, conformément à ce qui est détaillé au sein des CGV.
L’octroi d’une gratuité est limité dans le temps et peut être interrompu unilatéralement par le CNR à tout moment.
Article 3 - Subscription to the newsletter
The Site allows Users to subscribe to the CNR newsletter free of charge by providing their e-mail address.
By subscribing to the newsletter, the User receives a confirmation e-mail containing a hypertext link to the CNR website.
The User may request cancellation of his subscription at any time. E-mails sent by the CNR due to a subscription to the newsletter contain a link entitled "unsubscribe" allowing the User to unsubscribe. It is also possible for the User to formulate the unsubscription request by e-mail at the following address: cnr@cnr.fr.

The CNR is required to collect and process the User's personal data.

Article 5 - Declarations and Obligations of the User
By accessing the Site, the User undertakes to comply with the laws and regulations in force.
The User acknowledges :
– Avoir connaissance des principes qui sous-tendent au fonctionnement d’Internet et des réseaux de communication électronique et accepter ses caractéristiques et limites ;
– Avoir connaissance du fait que le CNR ne peut exercer aucun contrôle sur la nature et les caractéristiques des données accessibles sur Internet et qu’en conséquence le CNR ne peut assumer aucune responsabilité qui découlerait directement ou indirectement de ces données ;
– Avoir connaissance que les données circulant sur Internet ne peuvent être complètement protégées contre d’éventuels détournements et qu’il résulte que toute communication est faite aux risques et périls de l’Utilisateur. En effet, le CNR met en place des mesures techniques appropriées conçues pour protéger les données contre toute perte accidentelle ou tout accès ou diffusion non autorisés.
Toutefois, Internet demeure un système ouvert et le CNR ne peut garantir que des tiers non autorisés ne pourront passer outre ces mesures et accéder aux données.
– Avoir connaissance du fait que des virus peuvent être introduits par des tiers sur Internet et reconnaît en conséquence qu’il lui appartient de prendre toutes mesures propres à assurer la protection des données stockées sur son matériel informatique ;
By using the Website, the User assumes the risks relating to the completeness, accuracy or timeliness of the information on the Website that they use, at their own risk and under their own responsibility.
L’Utilisateur garantit le CNR et ses partenaires contre tout recours ou action de tout tiers, et leurs conséquences pécuniaires éventuelles, trouvant sa source dans l’utilisation du Site par l’Utilisateur ou dans la violation par l’Utilisateur des CGU, des CGV, de la Politique relative aux données à caractère personnel ou des dispositions réglementaires en vigueur.
As such, it undertakes not to use any software, applications, or technical means enabling it to interfere with the normal operation of the Site and Services as provided for in the Site's TOS and GTCS.
The User must ensure that they comply with the operation of the Website and the technical measures used to ensure the security of the Website and access to the Website.
Any violation of these TOS may be punished both civilly and criminally.
Article 6 - Access to the site :
The CNR strives to allow access to the Site 24 hours a day, 7 days a week, except in the event of force majeure, as defined by Article 1218 of the French Civil Code and by French case law, and also subject to possible breakdowns and maintenance or upgrading of the Site, without these interruptions giving rise to a right to compensation for the User.
The CNR may not be held liable when access to the Site is interrupted or impeded due to the quality of the Internet and electronic communication networks.
In addition, the User accepts that the CNR may have to interrupt the Site and all or part of its Services at any time and without notice.
The CNR shall not be held responsible in the event of impossibility of access to the Site and/or use of the Services, the Users waiving any claim or action in this respect.

Article 8– Propriété intellectuelle :
The Site is an indissociable whole. The information contained therein is reserved for exclusively personal use and may not be reproduced, in whole or in part, or communicated to third parties for any reason whatsoever.
The CNR is the exclusive owner of all intellectual property rights relating to the content (such as texts, graphic charter, visuals, sounds, images, photographs, domain name, logo(s)) appearing on the pages of the Site or has been granted licenses as such.
Likewise, it is the exclusive owner of the structure of the Site.
Any reproduction, representation, distribution or use of any kind, in whole or in part, of the content of this site, in any medium or by any process whatsoever, for any purpose other than personal, is prohibited without the prior consent of the CNR.
Failure to comply with this prohibition constitutes, in particular, an infringement within the meaning of Articles L.335-2 et seq. of the Intellectual Property Code, which may result in civil and criminal liability for the infringer.

As such, CNR cannot be held liable and makes no warranties, express or implied, and assumes no responsibility for the use of this information, the Services or the Website.
The User acknowledges that the CNR cannot be held liable for any direct or indirect damage, including material damage, immaterial damage, loss of data or programmes, or financial loss resulting from access to, inability to access, or use of the Website or any websites linked to it, or from the interruption, suspension, modification, or discontinuation of the Website or any of its elements.
Furthermore, CNR shall not be held liable in the event of inaccessibility of the Site, particularly during maintenance or in the event of force majeure.
In addition, CNR does not guarantee the completeness, timeliness or relevance of the information provided on the Site.
The User is advised that the CNR will provide any information enabling or facilitating the identification of any person guilty of an offence against the law or an infringement of the rights of the CNR or a third party at the request of an authority or court, such as IP addresses and connection times.
In the event that the CNR is held liable in a court of law due to a User's failure to comply with its obligations, the CNR may call upon the User as guarantor.
The User acknowledges that they are solely responsible for their use of the Website, the information and the Services accessible via the Website.
Article 10 – Droit applicable :
Both this Website and its Services, as well as the terms and conditions governing their use, are governed by French law, regardless of the place of use.
If any provision of these GCU is found by any authority or jurisdiction to be invalid or unenforceable, it shall be deemed unwritten and shall not invalidate the remaining provisions, which shall remain in full force and effect.
Article 11 – Juridictions compétentes :
Any dispute resulting from the use of this Site and the paid Services it offers or from the distribution of the information it contains will be under the exclusive jurisdiction of the Courts of Paris applying French Law.
